The Electricity at Work Regulations 1989 place a legal responsibility on employers, employees and self-employed persons to comply with the provisions of the regulations and take reasonably practicable steps to ensure that no danger results from the use of such equipment.
The Electrical Equipment (Safety) Regulations 1994 impose a statutory obligation on all landlords to ensure that all electrical appliances and equipment in the property are safe. It is recommended that an annual portable appliance test is carried out. Cabling, fuses and plugs must also be inspected and replaced where necessary with the correct rating for that particular appliance in order to comply with the Plugs and Sockets etc. (Safety) Regulations 1994.
The Smoke and Carbon Monoxide Alarms (England) Regulations 2015 state it is a legal requirement that all rented properties must have a smoke alarms on every floor and carbon monoxide alarms in every room where there is a solid fuel based appliance. Battery operated alarms are acceptable. Under the Building Regulations 1991 it is the law that all newly built premises from June 1992 must have mains fitted smoke alarms with battery backup.
Landlord Repairing Obligations
Section 11 of the Landlord and Tenant Act 1985 as amended by Section 116 of the Housing Act 1988 places an obligation on landlords to keep in repair and proper working order the installation for the supply of electricity to the property
